COMPETENŢA TRIBUNALELOR PENTRU ARBITRAJ SPORTIV LA NIVEL NAŢIONAL (RM) ŞI INTERNAŢIONAL

Abstract

The organization and conduct of sports activities are the source of sports disputes or conflicts of economic nature. In sports jurisprudence, mainly in professional sport, disputes are settled by alternative way, through arbitration, conventional means of resolving disputes appeared between the parties. Gathering of the legal conditions on the arbitrability of disputes is the key factor that determines the validity of the arbitration clause, but also the legality and enforceability of the arbitral decision. In the world of sports, the parties - clubs, teams, organizations, athletes, sponsors, patrons, employees, agents, etc. - interested in the issues of sports litigations have only one alternative, if they do not solve their differences amicably: to leave their settlement for the designated institution by the national / international federations or to the other competent bodies of that sport; to address to the courts, provided that they have jurisdiction over such matters. In Republic of Moldova only Moldovan Football Federation has functional sporty arbitration regulations and institutions, and at the international level the Court of Sports Arbitration (Lausanne, Switzerland) has general jurisdiction over all disputes that may arise during and / or after deployment of some sports activities or something related to it.
